Tote It Home Company

Rental Agreement & Terms and Conditions

Effective Date: July 24, 2026

This Rental Agreement and Terms & Conditions ("Agreement") is entered into between Tote It Home Company ("Company," "we," "our," or "us") and the customer identified on the reservation, invoice, or order confirmation ("Customer," "you," or "your").

By reserving equipment, paying an invoice, accepting delivery, picking up equipment, or otherwise taking possession of any rental equipment, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Rental Equipment

Rental equipment may include, but is not limited to:

  • 27-Gallon Reusable Moving Totes

  • Tote Carts

  • Animal Carriers

  • 3" × 5" Label Holders

  • 3" × 5" Index Cards

  • Accessories

  • Custom Rental Packages

  • Any additional equipment listed on the reservation or invoice

All rental equipment remains the exclusive property of Tote It Home Company at all times.

2. Definitions

2.1 Rental Period

The Rental Period begins on the scheduled delivery date or customer pickup date and ends on the scheduled return date listed on the reservation or invoice unless otherwise approved in writing.

2.2 Normal Wear and Tear

Normal Wear and Tear means the minor cosmetic wear reasonably expected during ordinary household moving and storage.

Examples include:

  • Minor scratches

  • Light scuffs

  • Minor abrasions

  • Normal dust

  • Minor fading

Normal Wear and Tear does not include:

  • Cracks

  • Holes

  • Broken lids

  • Melted plastic

  • Permanent marker

  • Paint

  • Adhesive residue

  • Smoke damage

  • Chemical damage

  • Excessive dirt

  • Missing equipment

  • Damage caused by misuse, neglect, or improper storage

2.3 Repair Charge

A Repair Charge may be assessed when equipment is returned damaged but can reasonably be repaired and safely returned to service.

Repair Charges will be based upon the actual cost of labor, materials, and replacement parts.

2.4 Replacement Charge

A Replacement Charge applies when rental equipment is:

  • Lost

  • Stolen

  • Destroyed

  • Not returned

  • Damaged beyond reasonable repair

Replacement Charges are based upon the values listed in Schedule A – Replacement Value Schedule.

Replacement Charges represent the agreed value of the equipment and do not constitute the sale of the equipment or transfer ownership. All rental equipment remains the property of Tote It Home Company regardless of whether a Replacement Charge has been paid.

2.5 Cleaning Charge

A Cleaning Charge may be assessed when equipment requires cleaning beyond normal household use.

Examples include, but are not limited to:

  • Food residue

  • Mold or mildew

  • Standing water

  • Paint

  • Glue or adhesive residue

  • Oil or grease

  • Smoke odors

  • Pet waste

  • Insects or rodent contamination

  • Chemical contamination

  • Excessive dirt or debris

3. Reservation and Payment

Full payment is required at the time of booking.

Reservations are not confirmed until payment has been successfully received.

No equipment will be delivered or released until payment has been made in full.

A valid payment method must remain on file until:

  • All rental equipment has been returned,

  • The equipment has been inspected, and

  • Any outstanding charges have been resolved.

4. Payment Authorization

The Customer authorizes Tote It Home Company to charge the payment method on file for amounts owed under this Agreement, including:

  • Additional Rental Charges

  • Repair Charges

  • Replacement Charges

  • Cleaning Charges

  • Additional delivery or pickup services requested by the Customer

  • Returned payment fees

  • Chargeback fees

  • Collection costs permitted by law

Whenever reasonably possible, Tote It Home Company will provide an itemized invoice before processing any additional charges.

If payment cannot be collected, the Customer remains responsible for all unpaid balances.

5. Equipment Delivery and Acceptance

Equipment shall be considered delivered upon:

  • Customer pickup; or

  • Delivery by Tote It Home Company to the agreed location.

The Customer agrees to inspect all equipment within 24 hours of delivery or pickup.

Any missing equipment or visible damage must be reported within that 24-hour period.

Failure to report discrepancies within 24 hours constitutes acceptance of the equipment as delivered.

6. Customer Responsibilities

The Customer agrees to:

  • Exercise reasonable care while using rental equipment.

  • Keep equipment reasonably clean and dry.

  • Protect equipment from theft, weather, fire, and misuse.

  • Return all equipment by the agreed return date.

  • Notify Tote It Home Company immediately if equipment is damaged, lost, or stolen.

The Customer shall not:

  • Modify equipment.

  • Drill, cut, or alter equipment.

  • Remove asset identification stickers.

  • Paint equipment.

  • Apply permanent labels or adhesives.

  • Store hazardous or illegal materials.

  • Sub-rent equipment without written approval.

7. Equipment Inspection

All equipment is inspected before each rental.

Upon return, Tote It Home Company will inspect all equipment and determine whether the condition constitutes:

  • Normal Wear and Tear

  • Repair Charge

  • Cleaning Charge

  • Replacement Charge

This determination shall be made reasonably and in good faith.

8. Inventory Verification

Customers are responsible for all equipment listed on the reservation or invoice.

Where applicable, equipment may be identified by individual asset numbers.

Example:

  • Tote T-0001 through T-0020

  • Tote Cart TC-0001

Customers are responsible for each listed item until it has been returned and inspected by Tote It Home Company.

9. Late Returns

Equipment not returned on the scheduled return date may incur additional rental charges.

Failure to return equipment after reasonable attempts to contact the Customer may result in Replacement Charges and any other remedies available under Texas law.

10. Delivery and Property Access

The Customer agrees to provide safe access to the delivery and pickup location.

Tote It Home Company reserves the right to refuse, delay, or discontinue service if conditions are unsafe, including but not limited to:

  • Aggressive animals

  • Flooding

  • Ice

  • Construction hazards

  • Unsafe driveways

  • Severe weather

  • Threatening or abusive behavior

  • Any condition reasonably believed to present a safety risk

11. Proper Use

Rental equipment is intended solely for household moving and storage.

Equipment shall not be used for:

  • Hazardous materials

  • Flammable liquids

  • Biohazards

  • Illegal activities

  • Commercial hauling without written approval

Animal carriers shall only be used for transporting domestic animals in accordance with applicable laws.

12. Communications

The Customer consents to receive communications from Tote It Home Company by telephone, email, or text message regarding reservations, delivery updates, invoices, payment reminders, equipment returns, and other account-related matters.

13. Assumption of Risk

The Customer assumes all responsibility for loading, unloading, lifting, stacking, transporting, and using rental equipment.

Tote It Home Company is not responsible for injuries arising from improper lifting, overloaded totes, improper stacking, misuse of equipment, or failure to follow safe handling practices.

14. Limitation of Liability

To the fullest extent permitted by Texas law, Tote It Home Company shall not be liable for indirect, incidental, consequential, or special damages, including damage to personal property, lost profits, loss of business, or emotional distress.

The Company's maximum liability shall not exceed the total rental fees paid for the applicable reservation.

15. Force Majeure

Tote It Home Company shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including severe weather, natural disasters, road closures, vehicle breakdowns, governmental actions, or other unforeseen events.

16. Cancellations

Reservations canceled prior to delivery or pickup may be eligible for a refund, less any applicable processing or delivery fees already incurred.

Once equipment has been delivered or picked up, rental charges are non-refundable.

17. Photography

Tote It Home Company may photograph rental equipment before delivery and after return for documentation of equipment condition.

18. Privacy

Customer information is used solely for reservations, billing, customer service, legal compliance, and business operations. Tote It Home Company does not sell Customer personal information.

19. Governing Law

This Agreement shall be governed by the laws of the State of Texas.

Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction in Hunt County, Texas, unless otherwise required by law.

20. Entire Agreement

This Agreement, together with the reservation, invoice, and Schedule A, constitutes the entire agreement between the parties and supersedes all prior discussions, representations, or understandings.

Any amendment must be made in writing by Tote It Home Company.

21. Acceptance

By reserving equipment, paying an invoice, accepting delivery, picking up equipment, or otherwise taking possession of rental equipment, the Customer acknowledges that they have read, understood, and agree to this Agreement in its entirety.

Replacement Charges apply only when equipment is lost, stolen, destroyed, not returned, or damaged beyond reasonable repair.
